I don’t see how this will stand in court…
It’s not just the design they stole, they right-clicked save-as the product images from dbrand’s website and put them on their own cases with minimal changes. You can see the dbrand logo on Castify’s cases.
How can they tell if it’s actually just the inside of the phone? If they took it from a phone wouldn’t it end up looking the exact same? It’s like trying to copyright a picture of a banana.
Obviously if it’s stolen like they claim they have a case I’m just not sure how they can tell.
Dbrand photoshops the images they take of the insides to look cleaner / more interesting and adds funny messages or secret number codes. All those messages and codes are in casetify’s designs. Also dbrand’s ducking logo.
DBrand added little extra details that didn’t exist on the real boards, officially as Easter eggs but probably also to serve as traps for plagiarists.
Because Casetify copied those extra details it proves they copied DBrand’s actual design rather than just copying the concept and using their own photos of motherboards, which would be allowed.
Dbrand has proof Casetify copied and sold their art work.

They literally ripped Dbrand’s online images, made a couple mods and started selling this shit. Minimum effort autism you can do in your basement with pirated Photoshop and 15 minutes of time.
People blaming the company, but it was really the lazy under paid designer that did this.
It is odd that they’ve collaborated with the Louvre and large corps in the past and somehow let something this stupid slip. But a company that large should have meaures to prevent it happening.

Any import of said merchandise should either be banned across all of copy write agreed countries until all associated fines and penalties are paid. Then they can sell their own unique designs.

Isn’t Casetify based in Chi-na?
They sell their cases in stores in the US and they have offices in LA. They do a lot of business in the US so an import ban would hurt them more than paying for damages. Asset seizure and freezing accounts is also a thing if they ignore the lawsuit.
They have American offices and I assume they’ve taken legal advice on whether this is worth the cost and assume it will be. Whatever happens the company’s name is tainted now.
They can be based anywhere they want to be, but their money runs through the US and if they lose in court that money can be collected on. They are a large company who would be foolish to close their company because they stole a few million from one creator. They are better off dragging this in court for 5+ years and finally settling then closing up shop just to avoid a relatively small penalty compared to the scale of the company.

I wouldn’t be surprised if it came out that Casetify was also the victim of either a 3rd party contractor of their own employee. It seems extremely unlikely a billion dollar company would directly copy something that could be done in a couple hours of work.
More likely they outsourced the tear downs and had no idea they were copied.
I mean maybe they outsourced it but that doesn’t make them a “victim”.
They are profiting off of the copies either way, and if you’re profiting off the work it’s your responsibility to check the work before it is put out to the public.

What happened?
The most recent was the pixel fold case.
The case shipped months after the phone released so I had to buy a temp case because I didn’t want to damage the phone. The cases edges are too high, so it breaks gesture navigation. When I tried to get a refund they didn’t want to refund the skins. I ended up keeping it as the temp case holding stickers wouldn’t secure anymore.
The case broke where the plastic was thinner near the camera cutout meets the side. The case now just falls off .
I bought an expensive thin magsafe/pop socket thing that will now need to be replaced. I can’t use my phone without a case so I’m on my third temp as I wait for Dbrand to respond.
All that said, the breaking of gestures is ridiculous. No one must have actually tested it to notice how much hard gestures are when you raise the edges so high.

If you’re looking for cases that can be mounted to almost anything including bicycles look at quad lock otherwise FRE’s Life Proof line is a decent but more expensive option.

Them to be smart about it since they have a presence outside of China. Meaning they can be prosecuted and something to lose.
There’s a reason why China knick knacks at your local supermarket cost more than ordering straight from China. It’s that the stuff has been somewhat vetted because the seller has to answer to powers that be.
It’s not like they are some random seller on Wish or Temu, they have offices in the USA and American employees. If they want to continue doing business in the US they are going to have to deal with this lawsuit.
